Six hundred thousand dollars was an interesting sum of money: large enough to alter a life, small enough to be discussed in court without anybody laughing.

David Vern had spent much of the morning looking at Steve Penderhurst and wondering what, exactly, six hundred thousand dollars’ worth of damage looked like. It looked surprisingly healthy. Steve sat twelve feet away in a charcoal suit, having previously suffered in navy at the preliminary hearing and grey during mediation. There was nothing visibly wrong with him, which David knew was a wicked thought and, worse, a legally irrelevant one. Trauma did not require plaster. Depression did not announce itself with a facial rash. Steve had reports: post-traumatic stress, disturbed sleep, intrusive recollections, depression, anxiety around traffic and a particular fear of pedestrian crossings which David, despite himself, found almost offensively specific.

“Nobody disputes the seriousness of the original incident,” the judge was saying, “nor, I think, does Mr Vern dispute his responsibility for it.”

“No,” David said, before noticing his barrister shift and realizing the question had not been addressed to him.

The original incident. That was what six months could do to the worst three seconds of your life. On 6 May, shortly after nine in the evening, David had driven through a poorly illuminated pedestrian crossing and hit Steve. It had rained earlier. David had consumed two glasses of wine with dinner. Steve had the right of way. Then came police, ambulance, breath test, hospital, conviction, driving ban and criminal record. The consequences proved more reproductive. David’s job required driving, so that went. His marriage, already carrying rather more structural weight than its architects had intended, followed. Louise took the children. David still saw them, technically. Technically he remained their father; technically every second weekend constituted a relationship.

David had accepted most of this, or told himself he had. He had hit a man with a car after drinking wine; the world was unlikely to organise a testimonial dinner. What he had not expected was Steve returning six months later with an invoice.

“Mr Vern’s position,” his barrister said, “is not that Mr Penderhurst suffered no psychological consequences. But proceedings were initiated approximately six months after the accident, by which time my client had been convicted, lost his license and employment, and experienced the breakdown of his marriage.”

“The defendant’s misfortunes,” Steve’s barrister replied, “do not reduce the claimant’s injuries.”

Misfortunes.

David almost admired it. Everything that happened to Steve was an injury. Everything that happened to David was a misfortune.

There had been a time when David desperately wanted to apologize. After the accident he had asked whether Steve was all right until a police officer told him to stop asking. He had tried to visit him in hospital and later wrote a letter his solicitor advised him not to send. Even after losing his job, Steve remained outside David’s expanding circle of blame. Why shouldn’t he? Steve had been walking across a road.

Then Steve discovered that David had money.

David could not prove the sequence mattered. He merely knew that it did.

The medical evidence was revisited. Steve woke sweating, experienced low moods, had become irritable and sometimes avoided the crossing. His marriage had survived. He continued working. His physical injuries had resolved. His body, in other words, had recovered with indecent efficiency. It was his mind that had become expensive.

Six hundred thousand dollars.

Had David been broke, Steve could presumably have experienced precisely the same nightmares for considerably less. His solicitor had explained the distinction between damages and recoverability. David understood it perfectly well. That was the problem.

Then Steve’s barrister returned to 6 May.

“You accept that you consumed two glasses of wine and subsequently drove?”

“Yes.”

“And failed to stop at the pedestrian crossing?”

“I didn’t see him on the crossing.”

His barrister looked at him.

David knew he should leave it alone.

“I saw him,” he said. “That’s what I’ve always tried to explain.”

“You saw Mr Penderhurst?”

“Yes.”

“Then I’m not sure I understand.”

“He was at the side of the road.”

“Except he wasn’t.”

“I know.”

“You struck him on the crossing.”

“I know.”

“Then you were mistaken.”

“Obviously I was mistaken. But something happened to me as I approached that crossing.”

The judge looked up.

“I know how it sounds,” David continued. “I wasn’t seeing double. I wasn’t confused. I saw Steve beside the crossing. I remember thinking he’d cross after I went through. Then I went through and hit him.”

“Alcohol can impair perception.”

“I know what alcohol does.”

“Mr Vern,” the judge said, “this was considered extensively during the criminal proceedings. There is no need to conduct those proceedings again.”

David nodded.

And that was that.

He remembered the crossing approaching beneath the headlights and Steve standing at the kerb. Then impact. The impossible thing was not that he had failed to see Steve. The impossible thing was that he had seen him, only in the wrong place. There were respectable explanations—alcohol, darkness, shock, memory, the brain’s enthusiasm for becoming defence counsel to its own mistakes. David knew them all. He wasn’t certain he believed himself.

But the memory remained: Steve had been at the side of the road.

By late afternoon the case returned to money. Experts had translated misery into arithmetic. Perhaps Steve really did wake at three in the morning with his heart hammering. Perhaps he saw headlights when he closed his eyes. David could believe all of it.

What he couldn’t believe was that it cost six hundred thousand dollars.

The judgment came shortly before four.

Steve won. The judge made no secret of his attitude towards drink-driving. In his written judgment he described it as an offence deserving of increasingly stern consequences and remarked that he was pleased, in this instance, to contribute to that sterner approach. David read that sentence several times. Apparently the six hundred thousand dollars was not merely compensation. He had also been selected for a small supporting role in the improvement of society.

Across the courtroom, Steve closed his eyes while his solicitor put a hand briefly on his arm. Nobody put a hand on David.

Outside, David’s barrister talked about costs and options while David watched Steve emerge from the courthouse. For a moment he hoped Steve might approach him—not to forgive him, nothing theatrical, merely to acknowledge that the thing had become grotesque for both of them.

Steve said nothing. He descended the steps and disappeared with his solicitor into the afternoon crowd.

David remained where he was.

Six hundred thousand dollars. The job. The licence. Louise. The children. There was apparently always something else available to lose.

By July the following year, David had been watching Steve Penderhurst for eight months.

He enjoyed it.

This had taken him some time to admit. At first he called it curiosity, then research, then preparation. Eventually there seemed little point lying to himself. Following Steve was the best part of his day. In the early months there had been notebooks, dates and times, until repetition made them unnecessary. Steve's working life now existed in David's memory with the dreary precision of a railway timetable.

Steve arrived between half past eight and quarter to nine, parking in a side street and walking the remainder to his office. On the way he crossed the same road. At lunchtime he generally crossed it again, bought something to eat and returned; after work he crossed once more on his way to the car. Three or four times a day, Steve Penderhurst presented himself to the crossing. David varied his observation points and kept his distance. Steve knew his face. One sighting could be coincidence, two unfortunate, three enemy action.

There had been, during those months, an attempt at another life. David applied for jobs, revised his CV, wrote careful covering letters and even bought a new shirt for a video interview. He expected a penalty for the conviction and was prepared to absorb one. What surprised him was how enthusiastically the penalty reproduced itself. Two promising interviews cooled when the conviction emerged; another employer required a clean driving licence. Then came the peculiar modern silence in which companies demanded your employment history, references, personal philosophy and several hundred words about your enthusiasm for joining their family before deciding you did not merit an automated rejection.

Eventually David stopped applying. There were jobs somewhere, certainly, and further opportunities to begin again at reduced altitude, but the idea had lost its appeal. He decided instead on a shortened timeline as a civilian. He had enough money left to survive for a while.

And, increasingly, he had Steve.

For the first time since 6 May last year, David possessed an advantage. Steve had known everything about him: conviction, employment, assets, marriage, finances. Lawyers had dismantled David's life and arranged the pieces on tables, and Steve had profited from what they found. Now the arrangement was reversed. David knew when Steve worked, ate and left; where he parked; which sandwich shop he preferred; even that on wet days he sheltered beneath the pharmacy awning until the crossing changed. Steve, meanwhile, moved through his days believing them private.

David found this delightful.

Sometimes he watched Steve reach the crossing and thought: Not today.

Steve would cross safely and continue on his way.

David had let him.

That was how he came to think of it. He could have acted months earlier, but surveillance had become too pleasurable to surrender. Once Steve was dead, the secret advantage would disappear at precisely the moment David exercised it. So he savoured it.

During the same period, he began talking to himself. What started as Steve will get what's coming to him became Steve Penderhurst will suffer, repeated morning and night until anger acquired the reassuring regularity of prayer. Later came Steve Penderhurst will know what it is to lose everything, and eventually:

Steve Penderhurst will be hit by a car.

David had read about affirmations and manifestation. He didn't particularly believe in either; the universe, in his experience, had shown little interest in taking instructions. He repeated the words anyway. They pleased him.

By August the sentence had become:

Steve Penderhurst will be hit by a car at the crossing.

The date came in a dream.

David remembered almost nothing else about it. There had been a building he didn't recognise, some people whose identities disappeared on waking, and amid the usual dissolving rubbish of sleep, one thing of peculiar clarity:

17 November.

The date meant nothing. No birthday, anniversary or appointment attached itself to it. Yet it felt settled. Not important, exactly.

Correct.

That morning David added it to the words.

On 17 November, Steve Penderhurst will be hit by a car.

Soon the date and event became difficult to think about separately. The wording hardened with repetition: Steve would suffer; Steve would be hit at the crossing; Steve would suffer real injuries. Eventually:

On 17 November, Steve Penderhurst will die.

There remained the practical inconvenience that David was banned from driving. A private seller thirty miles away solved this with an old saloon, twelve years old, scratched along one side and cheap enough not to attract attention. David gave a false name and paid cash; the seller's interest in administrative detail diminished markedly once the money appeared. The car was delivered to a rented lock-up on the edge of town. David didn't drive it on the road, although he visited periodically to start the engine and ensure it intended to cooperate when required.

By October there was little reason to watch Steve anymore, though occasionally David did so because he missed the pleasure. Steve would appear; David would observe him from a distance and think Not today. Another evening granted.

There were contingencies. Steve might be ill on 17 November, work from home or take leave. Other pedestrians might be crossing with him, in which case David would abort; he wanted Steve alone, as he was perhaps eighty per cent of the time. Strictly speaking, the seventeenth was merely the green-light day. If circumstances were wrong, there would be another.

Yet these contingencies felt increasingly ceremonial. David planned for them without believing they would be needed.

Steve would be there on 17 November.

More than that, he would be alone.

David didn't know how he knew this. Perhaps repetition had hardened prediction into memory. He no longer felt he was waiting to discover what would happen on the seventeenth.

He knew.

On 16 November, David watched Steve one final time. He saw him arrive for work, leave for lunch and return. Late that afternoon Steve emerged from the office, waited for the signal and crossed towards the side street where his car was parked.

For nearly a year, the man had been living inside a secret.

Tomorrow he would find out what it was.

That evening David ate at home, watched television and checked the weather.

Dry.

The car was waiting. The route had been rehearsed hundreds of times.

Before bed, David stood in front of the bathroom mirror.

Tomorrow, Steve Penderhurst will be hit by a car.

He considered his reflection, then corrected himself.

Tomorrow, Steve Penderhurst will die.

Tomorrow was 17 November.

David woke shortly after six and knew the date before he knew what time it was.

17 November.

He remained in bed for twenty minutes, surprised by how ordinary he felt. For months he had imagined this morning possessing some special atmosphere, as though the significance he'd assigned to the date might have contaminated the weather or altered the light. Instead there was the ceiling, the distant plumbing of another apartment, the faint pressure in his bladder. He showered and made coffee.

The surveillance was finished. David knew Steve's routine better than he needed to and, more importantly, knew when the only crossing that mattered would take place. He had spent months waiting for 17 November and had no intention of cheapening the occasion by watching the preliminaries. Morning, lunch, afternoon: Steve could have those. David would see him after work.

The day Steve died.

The phrase no longer troubled him. It empowered him. He felt like fate itself.

At twelve-thirty he glanced at the clock and pictured Steve approaching the crossing, then pushed the thought away. That wasn't the crossing that mattered. The seventeenth was merely the green-light day: from Steve finishing work onward, the first suitable crossing would be the one. If Steve appeared with colleagues or crossed alongside another pedestrian, David would abort and return tomorrow. He wanted Steve, not collateral casualties.

Yet somewhere beneath these sensible contingencies lay an unreasonable certainty that none would be required. Months of repetition had transformed 17 November from a prediction into something closer to a fact.

Today would work.

David spent the afternoon in his apartment. At four he changed into dark trousers, trainers and an unremarkable jacket, checked his phone and walked to the lock-up. Shortly before five he raised the metal door and looked at the old saloon he'd bought two months earlier.

The engine started immediately.

David drove with almost comic care: speed limits, indicators, mirrors, a complete stop at an amber light he could easily have beaten. If a police car appeared now, the whole enterprise might end with the bathetic discovery that Steve Penderhurst had been saved by a defective brake light.

At 5:08 David reached the road leading towards the crossing and parked approximately four hundred metres away. He had originally considered six hundred, but four gave him ample distance to build speed while remaining close enough to monitor Steve through the zoom lens on his phone. In the gathering dark the crossing itself was indistinct; magnified on the screen, it sprang towards him—the lights, white markings, opposite pavement and the mouth of the street Steve used on his way to his car.

He thought of the dark at five in November, and the dark at nine in May. Why had Steve worked late that night? David knew his habits now. Steve rarely worked late—once every few months, perhaps. Yet on 6 May he had been there, crossing that road at exactly the wrong time, just as David happened to be driving towards it.

What forces had brought them together that night?

David didn't know. But increasingly he disliked the word accident.

David settled in.

He had expected trembling hands, a pounding heart, perhaps nausea. Instead he felt the concentration of a man waiting for a particular train.

The first pedestrians were irrelevant: a woman, then a man behind her. At 5:29 three people appeared from Steve's direction and for a moment David thought the tallest was him. Wrong coat. Another man appeared alone at 5:33. Not Steve. There was no reason for concern; David had seen Steve leave as early as 5:15 and as late as 5:50.

At 5:41 a couple waited at the crossing while a cyclist passed behind them. David watched them cross and considered the rule. If Steve appeared among other people, he wouldn't move. There would be another opportunity. What mattered was that 17 November had arrived. The machinery was finally in motion.

At 5:54 the crossing was empty.

Steve wasn't there.

Six o'clock came and went. David's calm began to fray. Steve occasionally worked late, but by 6:15 the constant zooming had given him a headache and an unwelcome possibility had occurred to him.

Steve might have left early.

David rejected it almost immediately, not because he possessed evidence against it but because it felt wrong.

Steve was supposed to be here.

Supposed to be?

According to whom?

For months David had constructed this evening so repeatedly that somewhere along the way he had confused intention with memory. He didn't merely expect Steve to appear; some part of him felt he had already seen it happen. Steve would emerge alone, approach the crossing and press the button. The signal would change. Steve would step onto the road. David would start the engine.

That was what happened on 17 November.

Except it wasn't happening.

By 6:45 impatience had become anger. David wasn't frightened and, more surprisingly, wasn't relieved. He felt cheated. Now eleven months of watching, the car, the lock-up, the mantras, the date itself—and Steve Penderhurst had failed to attend.

Shortly after seven, David finally put the phone down. He stared towards the distant crossing with a resentment so disproportionate that under different circumstances he might have recognised its absurdity. Steve had already taken almost everything from him. Now he'd managed to ruin his own murder.

Fine.

Tomorrow.

The date had been arbitrary anyway: two words carried out of a dream and elevated into prophecy because David had needed something solid around which to organise himself. Tomorrow would be 18 November and Steve would still need to get to work.

David returned the car to the lock-up and walked home. It was 7:21 when he reached the apartment. He threw his jacket over a chair, plugged in his phone and went to the kitchen for water. The disappointment remained, but what irritated him most was the certainty. He had known Steve would be there.

Back in the living room, David picked up his phone and opened the local news.

The photograph registered before the headline.

David knew the crossing instantly. Police tape ran across the road, an ambulance stood beyond it and a dark car rested at an angle with two wheels on the pavement.

MAN KILLED AFTER CAR MOUNTS PAVEMENT AT PEDESTRIAN CROSSING

The incident had occurred shortly after 12:40 that afternoon. Witnesses reported seeing a vehicle leave the carriageway before striking a pedestrian near the crossing. The victim had been pronounced dead at the scene. The driver remained nearby and had been arrested.

David read the name of the victim.

Steve Penderhurst.

For several seconds he experienced no recognisable emotion. His mind rejected the information not because Steve was dead but because Steve had died incorrectly.

12:40.

At 12:40 David had been sitting in his apartment. He remembered looking at the clock and imagining Steve going out for lunch.

Steve had been going out for lunch.

David enlarged the photograph. The car wasn't his. Of course it wasn't; his car had been sitting untouched in the lock-up. A man had been arrested at the scene.

David put the phone down, then picked it up again.

17 November.

The same crossing.

A car had mounted the pavement.

Steve had been alone.

For several months David had repeated that Steve Penderhurst would be hit by a car on 17 November. He had planned the road, the speed, the crossing and, if necessary, the pavement. He had spent the evening waiting to make it happen.

He had been six hours too late.

Someone else had got there first.

30:T1b0b,

David had expected to be interviewed by the police.

More precisely, he had expected to be interviewed as Steve Penderhurst's killer.

Until yesterday evening, that had seemed almost inevitable. There would have been an arrest, a solicitor and questions about motive, followed eventually by the disagreeable business of explaining why a banned driver had acquired an old saloon under a false name, spent months learning another man's movements and finally mowed him down deliberately. David had mentally rehearsed portions of the interview in much the same way he had rehearsed the killing.

What he had not anticipated was sitting in the same sort of room while the police tried to determine whether he had anything to do with somebody else's murder of Steve Penderhurst.

There was an injustice in this which David almost admired. He had done all the preparation and another man had got the arrest.

“I imagine you know why you're here,” Detective Inspector Harris said.

“I can make a reasonable guess.”

“You've heard what happened?”

“I read about it last night.”

“How did you feel?”

“Shocked.”

“Upset?”

“No.”

David shrugged. “You know the history. It would be absurd for me to pretend Steve and I were friends.”

Harris reminded him of the civil case, the six hundred thousand dollars and the fact that David had openly resented Steve afterwards. David agreed with all of it. Yes, eventually he had hated him. Yes, the coincidence of another car hitting the same man at the same crossing eighteen months later was extraordinary. And yes, naturally the police were talking to him.

“You seem very relaxed.”

“Because I had nothing to do with what happened yesterday.”

“That isn't quite the same thing.”

“No,” David said. “It isn't.”

He found that he rather enjoyed silences now that somebody else was responsible for filling them.

Then Harris gave him the name.

Colin Kerr.

Colin Kerr? Who the hell is he?

It meant nothing.

David denied knowing him, meeting him, contacting him, using an intermediary, paying him or asking anyone to harm Steve. Each answer was wonderfully clean. David hadn't appreciated how pleasurable innocence could be when confined to a sufficiently narrow subject.

“Would you submit to a polygraph?”

“Delighted. Ask whether I know Colin Kerr, whether I've contacted him, paid him or asked him to hurt Steve. I'll stay all afternoon.”

“Polygraphs have limitations.”

“Fine. Waterboard me.”

The second officer looked down.

“That was a joke,” David said.

“I know.”

David nodded towards Harris's folder. “Now can you tell me who Colin Kerr is?”

“We're more interested in what you know about him.”

“Nothing. That's what makes him interesting.”

“Why?”

“Because a complete stranger appears to have killed the man who sued me for six hundred thousand dollars, at precisely the same crossing where I hit him. Believe me - I'm more puzzled than you are.”

“You're assuming Kerr killed him deliberately.”

David's amusement disappeared.

“Didn't he?”

Harris said nothing for a moment.

“There is CCTV footage.”

That was the first thing David genuinely wanted.

The vehicle, Harris explained, had left the road roughly thirty meters before reaching Steve and mounted the pavement. Steve saw it coming and moved into the road.

“And Kerr?”

“He changed direction.”

“Towards Steve?”

“Yes.”

“After Steve moved?”

“Yes. The vehicle then appears to accelerate.”

David stared at him.

For months he had imagined the maneuver in reverse. Steve on the crossing, David approaching. If Steve reached the pavement, David would follow.

Yesterday Steve had been on the pavement.

He had fled into the road.

Colin Kerr had followed.

“Jesus Christ.”

“So he murdered him.”

“We haven't established that.”

“You've described a man chasing another man with a car.”

“I've described what the footage appears to show.”

Harris said they had initially considered some kind of medical event, partly because of Kerr's behavior afterwards. He had not fled. He stopped the car and remained there until officers arrived. There was no indication of alcohol; toxicology was pending.

“What did he say?”

“Nothing.”

David frowned. “Nothing about Steve?”

“Nothing about anything.”

Not at the scene. Not during arrest. Not to doctors, police or family.

The room seemed subtly different.

“So you don't know whether he won't speak or can't.”

“No.”

Harris placed a photograph on the table.

“Recognize him?”

David studied it. A man somewhere in his forties. Short hair. Entirely ordinary.

“No.”

“Take your time.”

“I am. I may have stood behind him buying milk once, but no.”

He looked again.

Nothing.

“Who the fuck is he?”

“You tell me.”

David laughed.

Harris looked faintly irritated.

“Sorry,” David said. “But you have to appreciate this from my side. You think I know who he is. You have information on him that I am curious about. And neither of us will tell the other anything useful.”

“We know who Colin Kerr is.”

“Then you're winning.”

Harris took back the photograph, and David was surprised to find himself disappointed.

For months he had expected, in one possible future, to sit in a room exactly like this after killing Steve Penderhurst. He had imagined the questions, the evidence, the gradual narrowing of his remaining life. Yesterday should have been the beginning of that future.

Instead another man had arrived first.

“Were you pleased Steve was dead?” Harris asked.

“No.”

“Sad?”

“No.”

“Then what?”

“Shocked.”

“Anything else?”

David looked at Colin Kerr's photograph disappearing into the folder.

“Yes.”

“What?”

“Curious.”

The interview ended shortly afterwards. David left knowing almost nothing about Colin Kerr beyond his name, his face and what the CCTV appeared to show.

On 17 November, while David sat at home waiting for the appointed hour, Colin Kerr had driven onto the pavement towards Steve Penderhurst. Steve had fled into the road.

Kerr had followed.

Kerr had accelerated.

Then he had stopped the car and, apparently, stopped talking.

David had entered the police station expecting to enjoy being innocent.

He left wishing he knew of what.

Three years later, David still thought about Colin Kerr.

Not every day. Colin had gradually receded from obsession into that smaller collection of mysteries a person carried around without expecting answers: the vanished acquaintance, the unexplained noise in an empty house, the thing once seen at night which daylight had never satisfactorily accounted for. Occasionally, though, the name returned.

Colin Kerr.

The man who had given David his life back.

It was an indecent way of putting it, but David had never found a more accurate one. On 17 November, Colin had done what David intended to do, at the place David intended to do it, on the day David intended to do it. The difference was six hours. Colin had consequently spent three years in a secure psychiatric hospital while David had spent them slowly re-entering the world.

David's life was not magnificent. Magnificence had ceased to be a requirement. He had found work eighteen months earlier, after his driving ban expired, delivering specialist equipment between hospitals and clinics. The money was adequate and the hours suited him. There was a woman now, Rachel, whom he saw three or four nights a week and who had not yet expressed any desire to reorganize his personality. His children were older and saw him more often. Louise had become somebody he could speak to without afterwards requiring several hours alone.

Steady. That was the word.

David had come to value steady.

Sometimes, driving home from work, he thought of the other driver and experienced something dangerously close to gratitude.

Colin Kerr, the man I never met, is the reason I'm driving this car.

Because had Colin eaten lunch somewhere else that day, or left home ten minutes later, or simply continued along the road like every other motorist, David knew where he himself would probably be.

Not here.

After the police interview David had researched Colin with an intensity that briefly rivalled his earlier interest in Steve. The results had been unsettling chiefly because they weren't unsettling at all.

Colin Kerr had been forty-three, married, with two children. He worked in procurement for an engineering company and had recently received a modest promotion and bonus. Colleagues described him as sociable, dependable and in unusually good spirits during the weeks before Steve's death. There was no criminal record, no known psychiatric history, no financial crisis, no collapsing marriage, no grievance anybody could find against Steve Penderhurst.

He was also a serious amateur runner.

Three weeks before killing Steve, Colin had achieved a personal best in a half-marathon. David found photographs online: Colin in running gear, flushed and grinning; Colin with an arm around another competitor; Colin later holding up half a pint of Guinness in celebration. In the comments beneath another photograph, he congratulated several runners on their own times and joked about the condition of his legs the following morning. He was by all accounts a loquacious, friendly, family man.

Nothing about him looked like a man approaching catastrophe.

Nor, apparently, had anything been medically wrong with him. The early possibility of a stroke, seizure or other neurological event had gone nowhere. Toxicology found nothing explanatory. There had been psychiatric assessments, neurological examinations, scans and tests whose details were mostly kept private, but no hidden tumour or chemical revelation arrived to make Colin Kerr comprehensible.

Police even had text messages sent ten minutes before the incident in which he asked his wife what she wanted from the shops.

And yet, the CCTV remained.

Car onto pavement.

Steve runs.

Car corrects.

Acceleration.

Impact.

Then silence.

For three years Colin had not spoken.

David had followed the case closely at first, then intermittently as public interest faded. Colin had eventually been judged unfit to stand trial and transferred to a secure medical facility. Specialists disagreed over what precisely had happened to him. The newspapers used phrases such as catatonic presentation and profound psychiatric disturbance, which seemed to David elaborate ways of saying that nobody knew.

Because Colin wasn't unconscious. He ate. He slept. He walked when directed. He looked at people. He could apparently perform simple tasks and respond behaviorally to his surroundings.

He simply never spoke.

Not to police.

Not to psychiatrists.

Not to nurses.

Not to his wife.

Not to his children.

Nothing.

David sometimes wondered whether Colin remembered Steve at all.

More troublingly, he wondered whether Colin remembered 17 November.

On a Thursday afternoon in late November, almost exactly three years after the killing, David was driving north with a case of surgical equipment secured behind him when the thought returned.

Colin Kerr gave me this life.

He disliked the sentence and yet there it was.

At the next traffic light he looked at his hands on the steering wheel. Three years earlier those hands had been intended for another steering wheel, four hundred metres from a pedestrian crossing, waiting for Steve Penderhurst to appear.

Colin had appeared instead.

Not literally. David had never seen him that day.

But somehow the job had been done.

David had occasionally entertained the possibility of cosmic intervention, although never for long. The universe doing him a solid, as he'd once drunkenly described it to Rachel without supplying the details. Karma was another possibility, if karma had recently abandoned its traditional concern with moral proportionality and begun accepting private commissions.

Mostly he regarded it as coincidence.

He had become quite good at regarding it as coincidence.

There wasn't much alternative.

Two weeks later, Detective Inspector Harris was standing beside a filing cabinet when his phone rang.

The call lasted less than four minutes.

When it ended, Harris remained standing with the phone in his hand.

Detective Sergeant Mills, who had been at the original interview with David Vern, looked across from his desk.

“Everything all right?”

Harris didn't answer immediately.

“You remember Colin Kerr?”

Mills stared at him.

“Of course I remember Colin Kerr. The silent guy.”

“Penderhurst case.”

“I know which case.”

“Three years ago.”

“Yes, Harris.”

Harris sat down.

Mills watched him.

“What?”

“You remember where Kerr ended up?”

“St. Matthew's.”

“That was St. Matthew's.”

A pause.

“Colin Kerr started talking.”

By the time Harris reached St Matthew's, Colin Kerr had stopped saying Ben Macklin was dead.

This was inconvenient, since according to Dr Sayeed he had said it perhaps ten times.

The first nurse hadn't understood him. Colin's voice, unused for three years, was little more than a hoarse abrasion, and she had initially thought he was asking for something. She brought another nurse over. Between them they persuaded him to repeat himself until there was no ambiguity.

“Ben Macklin is dead.”

Nothing preceded it. Nothing explained it. These were, so far as anyone at St Matthew's could establish, Colin Kerr's first words in three years.

“And then?” Harris asked.

“He wanted to know the perimeter of the building.”

Harris looked at Sayeed.

“In meters.”

“Of course.”

They were sitting in Sayeed's office, a small overheated room in a secure hospital which Harris found disappointingly deficient in screams and padded walls. St Matthew's resembled an unsuccessful private clinic whose decorators had been told that everything should survive bleach.

Colin had spoken perhaps thirty or forty sentences since breaking his silence, most of them brief and oddly practical. He wanted to know how many circuits of the building would equal a half-marathon and, when told he couldn't presently run them, asked whether walking was permitted. He had also enquired whether the hospital needed help with procurement, his occupation before the killing, and what brand of disposable gloves the nursing staff used.

“Is this progress?” Harris asked.

“I've heard his voice for the first time in three years. Ask me in a month.”

Harris had already tried interviewing Colin that morning. Interviewing was generous. Colin sat beside a window in a communal room, thinner and greyer than the man Harris remembered, but apparently attentive. Questions about Steve Penderhurst produced nothing. Questions about the collision produced nothing. Questions about Ben Macklin produced almost nothing.

Only when Harris asked whether Ben Macklin was dead did Colin respond.

“Is Ben Macklin dead?”

His voice was so faint Harris had leaned towards him.

“Yes?”

Colin swallowed.

“Yes.”

“Who is Ben Macklin?” Harris pushed.

No answer.

Three years of silence and Harris had managed to conduct a conversation obtainable from a malfunctioning lift.

Sayeed could offer little explanation. Colin's medication hadn't changed. There had been no illness, procedure, unusual disturbance or obvious change in his physical condition. The original neurological investigations following Steve's death had found no stroke, tumour, seizure disorder or other satisfying mechanism. Colin had simply stopped speaking after killing a stranger with his car and, three years later, had started again.

There was, however, one difference.

“He seems less tense,” Sayeed said.

“Tense? He's barely done anything for three years.”

“Uncommunicative isn't unconscious, Inspector. Mr Kerr has always been aware of his environment. He eats, walks, follows routines, responds to instructions. But there has been a quality about him I'd describe as pressure.”

Harris disliked the word immediately.

“And now?”

“Less pressure.”

“Since saying Macklin is dead?”

“Apparently.”

Mills was waiting in the car park with his phone in his hand.

“You've got something,” Harris said.

“Possibly. Ben Macklin.”

“Go on.”

Mills had begun with Steve Penderhurst rather than Colin Kerr, working backwards through old companies, directorships and business associations. Seven years earlier, Penderhurst had run a small company with a man named Ben Macklin.

Harris looked back towards the hospital.

“Can we get hold of this Ben Macklin?” Harris said.

“No, we can't. He died this morning.”

Harris turned back.

“Cancer. Long-term. Treatment for several years. Nothing suspicious.”

“When exactly?”

“Just after six this morning, according to St. Judes hospice.”

For a moment Harris said nothing.

“When did Kerr start talking?”

“Just after seven, apparently.”

The hospital stood behind them, bland and rectangular in the afternoon light.

Mills looked at it.

“So Colin Kerr says nothing for three years. Ben Macklin dies at six in the morning. About an hour later Kerr starts talking.”

“Yes.”

“And the first thing he says is—”

Harris was already reaching for the car door.

“Ben Macklin is dead.”

A year later, there was still no explanation.

Colin Kerr spoke now. Not expansively, and seldom about anything that interested the police, but enough to make his former silence seem stranger rather than less so. He talked to his family. He complained about food. He had resumed running under supervision, first in tedious circuits of the hospital grounds and later on a treadmill. His doctors called this progress.

He never explained Steve Penderhurst.

He never mentioned Ben Macklin again.

David had researched the name, of course. There wasn't much to find, although what existed was suggestive in the irritating way of facts which refused to become evidence.

Macklin had once been Steve's business partner. Their company had done reasonably well until the partnership ended badly, with Macklin receiving considerably less than he believed himself entitled to. Steve had possessed the better lawyers and, apparently, the better reading of the agreements. There had been talk of litigation which went nowhere. Former colleagues remembered Macklin as furious. One described him as apoplectic. Another said simply that he had never been the same afterwards.

Steve, meanwhile, started another company and prospered.

David understood that part.

The rest was foggier. Macklin had apparently dropped out of everything, and developed an interest in the occult. There were references to Satanism, although David could never establish whether this represented religion, philosophy, provocation or merely the retrospective embroidery people applied to somebody once he became interesting. An old photograph showed Macklin among a group of solemn-looking people dressed mostly in black.

There was no evidence Macklin had ever met Colin Kerr.

David had no recollection of ever meeting Macklin.

Then Macklin developed cancer. Treatment continued for years. Eventually, one morning, he died.

About an hour later, Colin Kerr began speaking.

Ben Macklin is dead.

After three years of silence.

David occasionally returned to the material, usually late at night, but he had stopped expecting it to yield anything. There was nothing to solve. Macklin was dead. Steve was dead. Colin remembered nothing he was prepared or able to explain.

And David had his own unreliable contribution.

He still remembered the first accident.

That memory had survived police interviews, courtrooms, alcohol calculations, psychiatric explanations and the steady erosion of time. He no longer trusted it. He wasn't an idiot. Memory was reconstructive; shock distorted perception; darkness did the rest. Darkness in May? Yes, Steve inexplicably leaving late that day when David happened to be driving by.

David remembered.

Steve had been at the side of the road.

Not approaching it. Not halfway across. At the side.

David remembered seeing him there as the crossing came towards him. He remembered knowing there was no need to stop because Steve hadn't begun to cross.

Then the impact.

A heavy concussion through the front of the car. The terrible, unmistakable sound of having struck something substantial.

Even then, for perhaps a second, David hadn't thought of Steve.

How could it be Steve?

Steve was over there.

That remained the strangest part. Not the collision itself, nor the police arriving, nor the ambulance. His strongest memory was what came immediately afterwards: stopping the car, turning, looking back—

and seeing Steve Penderhurst lying injured in the road.

David remembered the surprise.

Not horror at first.

Surprise.

Because Steve wasn't supposed to be there.

Years later, David could still summon the other image more easily than the real one: Steve standing safely at the side of the crossing, waiting for him to pass.

There were explanations for that.

There were explanations for almost everything.

Nobody ever established how Colin Kerr knew Ben Macklin was dead.

After a while, people stopped asking.
